Mobile app

These Terms apply specifically to the Josiah Eats website.

The Josiah Eats mobile application has separate Terms of Service and a separate Privacy Policy governing use of the app.

Josiah Eats is a curated restaurant-discovery and editorial platform focused primarily on South Florida.

The Website may allow you to:

The Josiah Eats name, logos, branding, and associated visual identity may not be used in a manner that falsely implies authorization, endorsement, or affiliation.

Restaurant names, logos, photographs, trademarks, videos, and other materials may belong to their respective owners.

Displaying third-party trademarks or identifying information does not transfer ownership of those rights to Josiah Eats.

Limited permission

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Website for lawful personal purposes.

THIRD-PARTY SERVICES WILL REMAIN AVAILABLE;
EVERY LINK WILL CONTINUE TO WORK; OR
EVERY ERROR OR SECURITY ISSUE WILL BE PREVENTED.

JOSIAH EATS IS A DISCOVERY AND EDITORIAL SERVICE. WE DO NOT OPERATE THE RESTAURANTS FEATURED ON THE WEBSITE AND ARE NOT RESPONSIBLE FOR THEIR FOOD, SERVICE, SAFETY, BUSINESS PRACTICES, PRICING, AVAILABILITY, OR CONDUCT.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAFIERO MEDIA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

YOUR USE OF OR INABILITY TO USE THE WEBSITE;
RELIANCE ON RESTAURANT OR EVENT INFORMATION;
YOUR DEALINGS WITH RESTAURANTS OR THIRD PARTIES;
THIRD-PARTY SERVICES OR LINKS; OR
LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID DIRECTLY TO CAFIERO MEDIA LLC FOR USE OF THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $25 USD.

Nothing in these Terms limits liability that cannot lawfully be limited.

Some jurisdictions do not allow certain limitations, so some provisions may not apply to you.
