These Terms of Service (“Terms”) govern your access to and use of the Josiah Eats website located at josiaheats.com, including its restaurant profiles, Food Map, guides, events, editorial content, videos, and other website features (collectively, the “Website” or “Service”). The Website is provided by: Cafiero Media LLC 3800 S Ocean Drive Hollywood, Florida 33019 United States In these Terms, “Josiah Eats,” “we,” “us,” and “our” refer to Cafiero Media LLC and its applicable affiliates. By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, please do not use the Website. Our Website Privacy Policy also explains how information is collected, used, and protected when you use the Website. Mobile app These Terms apply specifically to the Josiah Eats website. The Josiah Eats mobile application has separate Terms of Service and a separate Privacy Policy governing use of the app.
2. What Josiah Eats Provides
Josiah Eats is a curated restaurant-discovery and editorial platform focused primarily on South Florida. The Website may allow you to: discover restaurants; explore restaurants using the Food Map; search restaurants and dining information; view curated restaurant profiles; read restaurant guides and editorial recommendations; discover dining events; watch or access Josiah Eats videos; follow links to restaurant websites, reservation platforms, maps, ordering services, and other third-party resources; subscribe to the Josiah Eats newsletter; contact Josiah Eats regarding partnerships or other inquiries; and access other features we may introduce. We work to make the Website useful, reliable, and easy to use, but the Website and its features may change over time. We may add, modify, limit, suspend, or discontinue features or Content when reasonably necessary for product, editorial, technical, legal, security, or business reasons.
3. Using the Website
We give you permission to use the Website for lawful personal and informational purposes, subject to these Terms. 4. Restaurant and Editorial Content
Josiah Eats provides curated restaurant recommendations, guides, profiles, commentary, videos, and other editorial Content. Restaurant recommendations and editorial opinions represent the views of Josiah Eats or the applicable contributor. We make reasonable efforts to provide helpful and accurate information, but restaurants and events can change without notice. Information such as: operating hours; menus; prices; addresses; availability; reservation availability; ingredients; ownership information; event schedules; and other restaurant details may become outdated, incomplete, or inaccurate. You should verify important information directly with the restaurant or applicable third-party service before relying on it. The inclusion of a restaurant on Josiah Eats does not constitute a guarantee regarding the restaurant’s quality, availability, safety, or future performance.
5. Food Allergies, Dietary Information, and Health
Josiah Eats provides restaurant-discovery and editorial information only. The Website does not provide medical, nutritional, dietary, allergy, or other professional health advice. Restaurants control their own: ingredients; recipes; food preparation; kitchens; allergy procedures; and food-handling practices. We do not guarantee that information concerning ingredients, allergens, dietary restrictions, nutrition, or food safety is accurate or current. We do not control and are not responsible for: third-party websites or applications; reservations; purchases or orders; restaurant availability; pricing; third-party content; service outages; or the privacy or security practices of third parties. Any transaction between you and a restaurant or other third party is between you and that third party.
8. Newsletter and Communications
You may choose to subscribe to the Josiah Eats newsletter or other optional communications. If you subscribe, we may send you communications about matters such as: new restaurant additions; guides; events; new videos; Josiah Eats updates; recommendations; promotions; and other relevant Content. You may unsubscribe from marketing emails at any time using the unsubscribe mechanism provided in the applicable email. 9. Contact and Business Inquiries
The Website may allow you to contact Josiah Eats regarding: brand partnerships; restaurant collaborations; tourism and destination work; events; video production; media inquiries; advertising; general business inquiries; or other matters. The Website and the Content created or owned by Josiah Eats—including, as applicable: restaurant guides; editorial recommendations; lists; descriptions; articles; notes; photographs; videos; graphics; logos; branding; designs; page layouts; databases and compilations; software; and the selection and organization of Content are owned by Cafiero Media LLC or our licensors and are protected by applicable intellectual-property laws. The Josiah Eats name, logos, branding, and associated visual identity may not be used in a manner that falsely implies authorization, endorsement, or affiliation. Restaurant names, logos, photographs, trademarks, videos, and other materials may belong to their respective owners. Displaying third-party trademarks or identifying information does not transfer ownership of those rights to Josiah Eats. Limited permission Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Website for lawful personal purposes. All rights not expressly granted are reserved.
11. Copyright and Intellectual-Property Complaints
We respect intellectual-property rights. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT: THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE; RESTAURANT OR EVENT INFORMATION WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT; A RESTAURANT WILL MEET YOUR EXPECTATIONS; THIRD-PARTY SERVICES WILL REMAIN AVAILABLE; EVERY LINK WILL CONTINUE TO WORK; OR EVERY ERROR OR SECURITY ISSUE WILL BE PREVENTED. JOSIAH EATS IS A DISCOVERY AND EDITORIAL SERVICE. WE DO NOT OPERATE THE RESTAURANTS FEATURED ON THE WEBSITE AND ARE NOT RESPONSIBLE FOR THEIR FOOD, SERVICE, SAFETY, BUSINESS PRACTICES, PRICING, AVAILABILITY, OR CONDUCT. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAFIERO MEDIA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO: YOUR USE OF OR INABILITY TO USE THE WEBSITE; RELIANCE ON RESTAURANT OR EVENT INFORMATION; YOUR DEALINGS WITH RESTAURANTS OR THIRD PARTIES; THIRD-PARTY SERVICES OR LINKS; OR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO CAFIERO MEDIA LLC FOR USE OF THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $25 USD. Nothing in these Terms limits liability that cannot lawfully be limited. Some jurisdictions do not allow certain limitations, so some provisions may not apply to you.

We may update the Website or these Terms from time to time. Reasons may include: introducing or removing features; changing business practices; adding or changing advertising; addressing legal or regulatory requirements; addressing security or technical concerns; or improving clarity. Nothing in this section prevents either party from pursuing a claim in an eligible small-claims court or seeking relief where applicable law provides otherwise.
19. Other Legal Terms
Entire agreement These Terms, the Website Privacy Policy, and any additional terms that expressly apply to a particular Website feature constitute the agreement between you and Cafiero Media LLC regarding your use of the Website. Consumer rights Nothing in these Terms limits rights that cannot legally be waived or restricted. Severability If a provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective. No waiver If we do not immediately enforce a provision, that does not mean we waive our right to enforce it later. Assignment You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction. No unintended third-party beneficiaries These Terms do not create enforceable rights for third parties merely because they may benefit from the Website. Force majeure To the extent permitted by law, we are not responsible for delays or failures caused by events beyond our reasonable control. Headings Section headings are provided for readability and do not change the meaning of these Terms. Language If these Terms are translated into another language, the English-language version will govern in the event of a conflict to the extent permitted by applicable law.
